It is not therapy, counseling, or medical or mental-health treatment, and using it does not create a therapist-client, counselor-client, or doctor-patient relationship. Please read the “Nature of our services” and “No professional or medical relationship” sections below.
These Terms of Service (“Terms”) form a binding agreement between you and ARISE (“ARISE,” “we,” “us,” or “our”), operated by Jeffrey Ly, governing your use of ariserepair.com (the “Site”) and our services. By using the Site or purchasing or participating in our services, you agree to these Terms. If you do not agree, do not use the Site or our services.
Nature of our services
ARISE offers educational and training services, information, and consulting designed to help adult men reduce or stop pornography use and improve their relationships. Our content and programs are educational and informational in nature and are provided for self-improvement purposes only.
No professional or medical relationship
Our services are not psychotherapy, counseling, psychological or psychiatric care, medical advice, diagnosis, or treatment, and they are not a substitute for care from a licensed physician, psychologist, therapist, or other qualified professional. Participating in our services does not create a therapist-client, counselor-client, physician-patient, or other professional treatment relationship. Although Jeffrey Ly has education and experience in psychology and mental health, when delivering ARISE services he acts solely as an educator, trainer, and consultant and not as your therapist, counselor, psychologist, or healthcare provider, and he is not providing licensed clinical services through ARISE. Communications with ARISE are not protected by therapist-patient or any other legal privilege and are not confidential in the way clinical records are.
Not a crisis service
ARISE is not a crisis or emergency service. If you are experiencing a medical or mental-health emergency, or are having thoughts of harming yourself or others, call your local emergency number or a crisis hotline immediately (in the United States, call or text 988 for the Suicide and Crisis Lifeline). Always seek the advice of a qualified professional about any medical or mental-health condition.
Your responsibility
You are solely responsible for your own decisions, actions, and results, and for obtaining any medical, psychological, legal, or financial advice appropriate to your situation. You participate in our educational and training services voluntarily and at your own risk.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site and our services.
Purchases, payments, and refunds
Fees, payment terms, and any refund or cancellation policy for paid programs are described at the point of purchase or in a separate program or enrollment agreement, which controls if it conflicts with these Terms. Unless expressly stated otherwise, fees are non-refundable.
No guarantee of results
Individual results depend on many factors within your control, including your effort and circumstances. We do not and cannot guarantee any specific outcome. Any examples, testimonials, or results shared are illustrations only, are not promises, and may not be typical.
Intellectual property and license
All content on the Site and within our programs, including text, graphics, audio, video, assessments, and materials, is owned by ARISE or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive license to access and use materials you purchase for your own personal, non-commercial use. You may not copy, record, share, resell, or distribute our materials without our written permission.
Acceptable use
You agree to provide accurate information, to use the Site and services lawfully and respectfully, and not to interfere with their operation, attempt unauthorized access, or misuse any content or community you are given access to.
Third-party services
We use third-party tools (such as scheduling, payment, and CRM providers) and may link to third-party sites. We are not responsible for their content, services, availability, or practices.
Disclaimer of warranties
The Site and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, ARISE and Jeffrey Ly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to the Site or services. Our total liability for any claim relating to the services will not exceed the amount you paid us for the specific service giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless ARISE and Jeffrey Ly from any claims, damages, liabilities, and expenses arising out of your use of the Site or services or your breach of these Terms.
Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute that is not resolved informally, and you consent to personal jurisdiction and venue there. Before bringing any formal claim, you agree to contact us first and attempt in good faith to resolve the matter informally. If you are a consumer who resides outside California, nothing in these Terms removes the protection of the mandatory consumer-protection laws of your country or state of residence that cannot be waived by agreement.
Changes to these Terms
We may update these Terms from time to time. The “Effective date” above shows the latest revision, and your continued use of the Site or services after changes means you accept the updated Terms.
General
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. These Terms, together with any program or enrollment agreement, are the entire agreement between you and ARISE regarding the Site and services. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
